PURPOSE, GOALS & CONDITIONS
By joining in on Y programing, I understand that I am coming together with others in the community who are committed to youth development, healthy living and social responsibility to make sure that everyone regardless of age, income or background, has the opportunity to learn, grow and thrive. All program participants are required to present a valid membership card for identification or photo ID when using the YMCA facilities and programs. Membership privileges and cards are not transferable, remain the property of the YMCA, and must be returned upon request. Membership and Program Subscription in the YMCA continues indefinitely until written notice of cancellation is provided in person by the member or is canceled by the YMCA in accordance with policies and procedures. Terms and conditions of the defined membership are subject to change. I agree to abide by the current membership and program subscription policies and procedures, code of conduct/bill of rights, privacy policies, and agree to abide by the rules and policies of the YMCA, including any future changes approved by the governing bodies in accordance with its Charter and Bylaws. The YMCA conducts regular sex offender screenings on all members, participants, and guests. If a sex offender match occurs, the YMCA reserves the right to cancel membership, end program participation, and remove visitation access.
WAIVER
I understand that the YMCA assumes no responsibility for injuries or illnesses which I may sustain as a result of my physical condition or resulting from my participation in any athletic activities, sports program, the use of any equipment, exercise, or other activities. I acknowledge on behalf of myself and my heirs that I assume the risk of any and all injuries and illnesses, which may result from my participation in these activities. I hereby release and discharge the YMCA, its agents, servants, and employees from any and all claims for injury, illness, death, loss or damage which I may suffer as a result of my participation in these activities. I understand that the YMCA is not responsible for personal property lost or stolen while members and/or program participants are using YMCA facilities or on YMCA premises. This membership/program subscription is not a contribution to the YMCA and is not tax deductible. By participating in the YMCA Nationwide Membership Program, I agree to release the National Council of Young Men’s Christian Associations of the United States of America, and its independent and autonomous member associations in the United States and Puerto Rico, from claims of negligence for bodily injury or death in connection with the use of YMCA facilities, and from any liability for other claims, including loss of property, to the fullest extent of the law.
I agree to take personal responsibility for myself and my family while participating in this program. Personal responsibility may include but not be limited to; initial temperature monitoring upon arrival, self-monitoring temperatures each day, following social/physical distancing protocols, and following appropriate hand-washing, cleansing and sanitation practices as defined by the YMCA and for as long as this is deemed necessary for the safety and protection of all participants and YMCA team members by the MDH and the CDC.
PAYMENT OPTIONS/TERMS
The monthly EFT plan is an ongoing payment plan for membership/program subscription. The pre-approved monthly payments are automatically deducted from your checking, savings or credit card account. Written, in person, cancellation notice is required prior to your EFT for cancellation. By cancelling a wellbeing subscription, I understand that any unused sessions will expire on the last day of the paid month.
- You will be given a 30-day written notice in the event of any membership/program subscription rate changes.
- If our initial attempt to complete the EFT is unsuccessful, we will make a second attempt to collect the payment. If both attempts to complete the monthly EFT are unsuccessful, the payment must be made directly to the YMCA. The YMCA holds the right to cancel the membership if the monthly payments remain unpaid.
All membership/program subscription fees are non-refundable.
*Personal Training Sessions may be rescheduled at any time with 24-hour advanced notice to your trainer if unable to attend a session. Clients forfeit any session for they do not attend or any session for which they cancel within 24 hours of scheduled appointment time.
YMCA PHOTO/AUDIO VISUAL/NARRATIVE RELEASE
I am 18 years of age or older and, if not, my parent or legal guardian has also provided their consent by signing.
Consent & License. For my participation in activities to be conducted by the National Council of Young Men’s Christian Associations of the United States of America (“YMCA of the USA”) or any of its chartered member associations in the United States (collectively “the Y”), and collaborating third parties, I consent, now and for all time, to the making, reproduction, editing, broadcasting or rebroadcasting of:
- video film or footage of me
- soundtrack recordings of me
- photo reproductions of me
- any narrative account of my experience
My consent includes a perpetual license to the Y and collaborating third parties for the use of the above materials for publication, display, sale or exhibition in promotions, advertising, education and commercial uses. Use includes reproductions in any form and media currently existing or later conceived, adaptations and/or revisions, throughout the world in perpetuity.
I understand and agree there may be no additional compensation for this license, and I will not make any claim for payment of any kind from the Y or collaborating third parties. I may, or may not be, identified in such licensed uses; however, my name will not be used to endorse any particular products or services.
Ownership, Confidentiality, and Shared Use. With respect to any of the above uses, I further agree:
- All works shall belong to YMCA of the USA;
- The Y has no duty of confidentiality regarding any licensed uses;
- YMCA of the USA shall exclusively own all known or later existing rights to the uses throughout the world;
- The Y and collaborating third parties may use any video film, footage, sound track recordings and photo reproductions of me and/or my narrative account for any purpose without additional compensation to me.
Release from Liability. I agree that my consent is irrevocable. I hereby release and discharge The Y and collaborating third-parties, from any and all claims, actions, lawsuits or demands of any kind arising out of my consent, license grants, uses, or the shared uses of any works or materials referenced herein.
MEMBERSHIP AND WELLBEING CODE OF CONDUCT
YMCA Member, Participant, and Guest Code of Conduct
Our membership code of conduct embodies the spirit of the Y, and is intended to help everyone including members, participants, and guests feel welcome and safe at the YMCA.
As a member, participant or guest, you agree to follow our code of conduct which is rooted in the values of caring, honesty, responsibility, and respect. That’s why the following personal conduct is prohibited in all YMCA facilities, programs, and online communities:
- Inappropriate attire. Appropriate attire must be worn at all times. No clothing with vulgar language, obscene gestures, racial slurs, or anything that contributes to a hostile environment or would be considered inappropriate in a family facility.
- Inappropriate language. Hostile or vulgar language, including swearing, name-calling or shouting.
- Threatening physical contact. Physical contact with another person in any hostile or threatening way including but not limited to “play fighting”.
- Sexual activity. Any demonstration of sexual activity or sexual contact with another person.
- Harassment / intimidation. Harassment or intimidation by words, gestures, body language or any menacing behavior that demeans another person or culture.
- Theft / destruction of property. Theft or behavior that results in the destruction of property.
- Weapons. Carrying or concealing any weapons or devices or objects that may be used as weapons (including items that appear to be real). The YMCA bans all weapons on premises with or without a permit.
- Illegal drugs or alcohol. Using or possessing alcohol or drugs on YMCA property, in YMCA vehicles, or at YMCA sponsored programs.
- Inappropriate conduct. Any other conduct of an inappropriate, threatening or offensive nature.
- Loitering. Loitering is not permitted in or outside YMCA facilities or programs.
- Inappropriate cell phone activity. Cell phone or photographic/video equipment use of any kind – organizing playlists, music, texting, camera functions, video recording – is not permitted in the locker rooms at any time. Phone calls are not allowed in fitness areas.
- Tobacco. The use of tobacco or tobacco-like products, including e-cigarettes, are not permitted in or outside YMCA facilities or programs, or on YMCA property or program sites. YMCA facilities, ground, and vehicles are a tobacco-free environment. Social Media. Use of social networking websites in a manner that is contrary to the YMCA’s mission, is detrimental to the community or is in violation of the law.
- Members and guests not employed by the YMCA are prohibited from providing personal training and related services for compensation within the Y. Personal training and related services may only be provided by authorized YMCA team members. Violation of this policy may result in termination of your membership and potentially bar guests from future membership.
- If anyone is suspected of providing unauthorized personal training and related services within the YMCA, the following action will be taken:
- On the first offense, the suspected individual will be asked to discontinue the present session. They will be given a verbal warning, including an explanation of the policy prohibiting this type of activity and a warning that any future activity of this sort will result in termination of their membership. The name of the member involved, and other salient details will be recorded and communicated to other branches.
- On a second offense, the membership of the individual providing the personal training service will be terminated.
If a member, participant or guest feels uncomfortable in confronting someone directly about offensive behavior or other issues that are in violation of the code of conduct they should report the behavior to a YMCA team member.
Suspension or termination of YMCA membership may result from a violation of this Code of Conduct. While an incident is being investigated, the membership of the person(s) accused of violating this Code of Conduct may be temporarily suspended pending a final decision.
To create and maintain a space that embodies our core values, the Y is serious about being clear regarding activities that are not allowed. If you or your invited guests violate this code of conduct, consequences can include termination of membership or program privileges. The YMCA reserves the right to make situational decisions based on its mission and values.
I have read, understand, and fully agree to the provisions of The Purposes, Goals and Conditions, The Waiver and Release, Code of Conduct, Photo/Audit Visual/Narrative Release and the Payment Options and Terms. If your membership ends, the YMCA imply your original signature agreeing to the terms and conditions dated on this form, and not canceling your membership based on any annual membership terms and conditions changes; that you are leaving the YMCA still agreeing to membership terms and conditions. If your membership is reactivated within a year of this form, the YMCA will not require a new membership agreement form to be signed, as previous agreements will be implied. Annually the YMCA will email updates to the membership terms and conditions, and usage implies agreement.
I acknowledge that I have read this in its entirety and Agreement freely, voluntarily, under no duress or threat of duress, with inducement, promise or guarantee being communicated to me.
